Letter from Steven Manos (2082) – Aggressive Dogs

Discussion:  Steve Manos (2082) spoke with county after aggressive dog incident, correct course of action is to call HS Public Safety, second call to the county if the dog owner is known. Would like to see the Board increase fines for aggressive dogs.   Hold the owners responsible for their animals. 

Scott Webber - the first incident that was reported to HS Public Safety, the member was fined.

Old Business

Boat Lift Rule – no changes or recommendations at this time, will vote on at the August 10th meeting.

319 Project Update -  Glenn Dalton, culvert to be put in July 14th, ½ acre pond is filling with water which is going to be pumped out to continue the dig of the North Basin.  Should be complete in August  Conversation ensues.

Covenant Vote – Scott Webber reminds everyone to get their vote in for the Covenant changes.

We currently are at about 20% of goal.  Please remind your neighbors to vote.

Wakeboard boats – Rocky Lane (1047) reads letter from Rich Hertell (679) asking the Board of Directors to revisit the boating rules and add the following:

            “All watercraft operated on Holiday Shores Lake must adhere to and comply with the State of Illinois Boating Rules and Regulations and also Holiday Shores Boating Rules and Regulations.”

Revise the Size Limit section to include “legal” length as follows:

Pontoon boats, (tubular bottom) operated on Holiday Lake shall not exceed twenty-eight (28) feet in “legal” length. All other watercraft shall not exceed twenty-two feet in “legal” length. (All watercraft registered with the Holishore Association prior to 1/1/89 shall be considered exempt from this rule.)

Add a new section called Capacity Restrictions and note the following:

No watercraft should be loaded with passengers or cargo ( such as water ballast, concrete blocks, and other similar devices) beyond its safe carrying capacity as per the manufacturer’s Capacity Plate.

Add a new section called Excessive Wakes and note the following:

No artificial weighting of any kind to increase the size of a watercraft’s normal wake will be allowed in any boat used on Holiday Shores Lake. This includes but not limited to water sacks, coolers of water, cement blocks or other similar devises. Boats with wedges or boats with water ballast tanks designed to increase wakes are not be allowed.

Scott Webber – Only 5 people from each side showed up.  Since this issue started, Board members have been spending a considerable amount of time on the lake.  Specific to the fishing cove, didn’t count of number of boats, but very busy cove.   Glenn has put additional bouy out in that cove and a little farther out. 

Rocky Lane (1047) – since this issue has been mentioned, has seen a lot less of a wake problem in the pass couple of weeks.  Sometimes all it takes is for the word to get out.

Scott Webber -  how are boats weight measured. I does IDNR weigh boats.  How many weight limit citations has IDNR issued.

Glenn Dalton  -  IDNR has not addressed weight out here other than too many passengers on boat.

Joe Nicoloff -  wake boats generally use the lake in the morning hours.

Rocky Lane – have to have a rule that says must comply with compacity limits for the boat.

Jason Hicks – not opposed to putting something in the boating rules about following state of Illinois rules, however do we do the same for driving on the roads.  If IDNR are out here enforcing the rules of Illinois.

Rocky Lane -  feels that people should still be made aware of it, so there is no question.

Joe Nicoloff  makes a motion that the staff when boat stickers are applied for, boats that are  listed as 21 ft and over should be measured.  No second, motion dies for lack of a second.

Glenn Dalton –  There is no doubt that we are IDNR managed water way.   Rules are on the website, available in the office, and in the holiday times and all new members are given a copy.

Cindy Manos (2082) Knows from expierence that things are a learning expierence.  Maybe handout boating rules and state rules at the time of boat sticker registeration.

Dave Decker  -  not cost effect to hand out a copy of the boating rules.

Rocky Lane (1047)  Boating Rules committee was challenged with coming up with a program to make sure boats passed inspection.  The new program would read as follows:

  • Any person requesting a Holiday Shores Boat sticker must have their watercraft safety inspection before they can obtain a sticker.  Each watercraft must have the required equipment (what is applicable to that watercraft).
  • The cost of each sticker will be $5.00.  Inspections will be made at the clubhouse, the marina or your residence by appointment with security.  Once your watercraft is inspected, no further inspections are required.
  • When you purchase or acquire added watercraft an inspection will be required before stickers will be issued.
  • There will be a yearly resigning of the rules for all previously inspected watercraft and a $5.00 fee for each sticker.

Attached would be a watercraft safety equipment list and a watercraft operation sheet.

Dave Decker so if I bought a boat this year, had it inspected, I wouldn’t have to have it reinspected again?

Scott Webber but each year you would have to sign document stating that you know the rules.

Dave Decker  not his responsibility to make you sign something, it is the members responsibility to know the rules and regulations.

Ray Garber (1827)  The more people we have with the proper equipment the better to prevent or help with an accident and have the equipment to do so.

Trevor Martin (1285)  Before boat inspection, seek legal council would that make Holiday Shores liable in an accident?

Monte Thus (6)  more than just wakeboats, a lot more additional traffic equals more wake.

Rip rap seawall way to go.  Need to educate boaters, not the boats, boat drivers are the issue.

Jason Hicks  boatings rules power turns are allowed.  Boating operation is an issue.  Look at power turns.

Ray Garber (1822)  Boat drivers causing wake find away to get across to boat drivers, another problem is the recommended seawall height.

Recommended seawall heights

Scott Webber asks about recommended seawall heights.

Glenn Dalton spoke with Roger Groth about recommended height should be.  A good recommendation was 507.  Normall pool is 505.  Wake limitation at 505.9.  Most seawalls fail from the rear, water washes over then out.  No heights are mandated, just recommended.

Benchmark was never in place before.  We now have several two at the dam, one by the clubhouse, just north of ski beach.

Variance request – Dog Pen

Janet Harris (140) requesting a variance for a dog pen instead of 72sq I would like to make it 264 square feet.  

Building Committee recommends putting up a 6ft fence in lieu of such a large pen.

Scott Webber you have to lots are they legally joined.

Discussion:  Dave Decker asks what type of dogs. 

Joe Nicoloff - Why don’t you just fence in the yard?

Gerry Theodore -  the building committee goes by esthetic.  If you need that big of pen, then a fence is more esthetic.

Dave Decker:  the cost of doing a fence is going to be a lot more than the pen.

Maintenance of Property:  structures on all property, whether occupied, in use or not, shall at all times be maintained in an as built status and in such a manner as to prevent their becoming unsightly by reason of deterioration, this includes homes, garages, sheds, fences, docks, boat lifts, seawalls, pools or any other structure built or erected on building lots.

Non-compliance of permit process:  a member not in possession of or in violation of our permit approval process will be required to complete the appropriate permit and pay the appropriate fee; however, the amount normally refunded will be forfeited as a fine.  Upon approval of a permit all current stipulations indicated in the rules will apply and violation shall be just cause for monetary fines as well as the suspension of a member’s right to use Association facilities.  Warning letters may be issued by the Holishor Association prior to any monetary fine or suspension of a member’s right to use Association Facilities.

Nancy Dallas (695) Neighbor didn’t get the covenant ballot, can they get a new one.  Advised to call the office for a new one.

 

Mark Dooley (1825) Has concerns with additional rock that was dumped on Port Lane for parking, causing flooding in his driveway.

Does Madison Communications have exclusive rights out here.  When does the contract with Madison come up for renewal? Would like to see AT&T U-verse out here.

 

Jerry Theodore (1346) AT&T U-verse is not available in Holiday Shores, because of equipment issues.
