DCEO Update
The fourth extension was signed today they are going in tomorrow to do the work, power washing and concrete. It should take about 10 days if the weather holds. The lake has been dropped 12 inches to ensure that should we have rain they can still continue to work in the pipe.
Jim McCann: When was the last time we had 10 days without significant rainfall?
Glenn Dalton: That is why we have it down 12 inches, the forecast seems as though it will permit us to do it at this time. That is also why we are using artificial heat, to expedite the cure time.
Jim McCann: We have had this discussion to a certain degree over the phone back in December when we thought the same thing, it was determined at that time that 8 inches or 9 inches was going to be sufficient and we were going to get in and out and it hit the fan, it is the middle of February and we still don’t have it repaired.
Action: Jim McCann motions that we drop the lake 24 inches, not 12 so that if it does rain, we are not in the same situation we have been in since the middle of October, David Decker seconds (for conversation purposes)
Jim McCann: We have been dealing with water for so long now we cannot get this thing fixed. We are on our 3rd extension and have just filed for our 4th. Most are delays due to contractors or the weather; we can’t help the delays with the Contractors or inspectors. We can to a certain degree control the delays that are caused by the weather, by simply dropping the lake another foot. Even the worst rain we have had, with the exception of the Great Webber Flood on Memorial Day, hasn’t brought the lake up more than 14 inches. So that would still give us a cushion. If we get halfway through this job again and it rains again, we could be back at square one. The lake is hardly being used at the moment. We should take it down before the spring rains hit and we really have a problem.
David Decker: We are currently 12 inches below full pool that is the tip of the Morning Glory; we have sandbagged the top of the Morning Glory 24in high. What volume of water coming through those sand bags presents an issue? We know we have leakage from the gate.
Jim McCann: If the lake was back to full pool, regardless of the sand bags, wouldn’t OSHA shut them down for the safety of the workers?
Glenn Dalton: With water up to the sandbags yes they would.

Vernon Abert 1823 Port Lane: Is it against the Bylaws to drop the lake without approval?
Scott Webber: No
Vernon Abert 1823 Port Lane: Were going to find that some of the sea walls, if we drop the lake down have some pressure back up against them. I don’t know if that is a real good idea, we had a lot of problems with the gate opening and closing.
Scott Webber: That has been resolved

David Decker: Jim I understand you, I am anxious to get this repair done. It just concerns me lowering the lake that much. They say they have a 10 day window that they need. Every time we had a window there was an engineering issue that we had.
Jim McCann: Or Rain, it has been up and down so many times, that’s how we know we can raise the gate.
David Decker: I am not a fan of that.
Vernon Abert 1823 Port Lane: Glenn, you are telling me that these engineers looked at this gate and made adjustments on this gate?
Glenn Dalton: No, they just looked at it.
Vernon Abert 1823 Port Lane: They looked at it, and they insured you it’s not going to leak any worse than it is now?
Glenn Dalton: Yes they did

David Decker: So if we decide to lower it we have the risk of damaging sea walls, the lake not coming back up in a timely fashion and we delay their start of work at least one day. That’s probably my biggest concern. If we can get them started tomorrow and we think we have a 10 day window, I think we should try it one more time. If we have this conversation again I will be more likely to go your way.

Jane Unsell 81 Christmas Tree point – By-lot Assessment
Jane Unsell 81 Christmas Tree Point: As I suggested in the correspondence, I recently moved into Holiday Shores, I have been coming out here for years as I have friends on the lake. I don’t think it is a surprise to anybody here that the roads in Holiday Shores would benefit from some additional funds as far as maintenance. When I became a member I went through the bylaws and it is clear that your membership dues are based upon a membership as opposed to a lot by lot. All these lots are located at Holiday shores, they all benefit from the dues but there are no extra fees for owning extra lots. I am a Attorney in East Alton, and having looked at a few of these types of Home Owners associations I find that a lot based assessment is more common than a membership based assessment. It makes sense to have a lot based assessment because each lot gets the benefit of the home owners association and should pay the fees. That is not what is happening out here in Holiday Shores. I think it is only equitable that the people out here that own one lot pay their dues and those that own multiple lots should pay on each one. There are a lot of unimproved lots out here that are owned by companies that are making money off of these lots when they go up in value. It is my proposal, to amend by simply inserting the highlighted verbiage.

4 Years ago a bylaw was put in for change with just a $50 assessment for each lot, it failed by a landslide. The board doesn’t disagree that it is a good idea, but getting it to pass will be a challenge.
Jane Unsell 81 Christmas Tree Point: Are you saying that because of a Landslide you would be unwilling to try it again? Especially with this economy and the way we need money?
Jim McCann: We needed the money a lot more back then than we need it now. What I am saying is that the Association Financially was in a worse off shape, we were able to get assessment increases.
